Over the past few months, the Office for Civil Rights (OCR), Center for Medicare & Medicaid Services (CMS), Office of Inspector General (OIG) and the Federal Trade Commission (FTC) have investigated privacy and security violations of various entities in the healthcare industry. From Providence to the Veterans Administration to CVS and beyond, we are in a period of rising investigations and increased consequences in terms of penalties and monitoring.
Key changes in the new stimulus bill (HITECH Act) include regulation of business associates as well as a strong security breach notice requirements. Rules are also tightened in several areas for HIPAA Privacy & Security and penalties have been increased for non-compliance as well as significant funding for aggressive enforcement.
