- The New HITECH Act and HIPAA: Increased Penalties, Audits & New Requirements – Monthly HIPAA Compliance Tip

The Health Information Technology for Economic and Clinical Health Act, or the HITECH Act, was signed into law on February 17, 2009 as part of the economic stimulus package. This new legislation establishes new enforcement provisions as well as penalties that impact covered entities, business associates, vendors and others. The HITECH Act is divided into several parts, or subtitles.
-Subtitle A (Promotion of Health Information Technology) contains provisions to promote the creation of a nationwide health information technology infrastructure that allows for the electronic use and accurate exchange of health information, with the goal of a certified electronic health record for each person in the United States by 2014. It will result in voluntary standards for the certification of electronic health records
-Subtitle B (Testing of Health Information Technology) requires the National Institute of Standards and Technology (NIST) to support the establishment of a conformance-testing infrastructure, including the development of technical test beds. This may include a program to accredit independent, non-Federal laboratories to perform testing.
-Subtitle C (Grants and Loans Funding) provides financial incentives and funding for the adoption of health information technology.
-Subtitle D (Privacy and Security) contains provisions for the privacy and security of health information. The privacy and security provisions generally take effect 12 months after enactment of the Act (i.e., February 17, 2010).
Most of the provisions of the Act go into effect one year after enactment of the law – which would be February 10, 2010. However, increased penalties go into effect immediately. New requirements have been introduced in several areas including breach notification and significant additional requirements for business associates.

Together these agencies are implementing the Maryland Telepsychiatry Program, taking advantage of TANDBERG video communications to connect psychiatrists at the University of Maryland School of Medicine with patients in rural Maryland.
